Today, after around 10 years of negotiations, China and Australia signed a Free Trade Agreement. With the text of the China-Australia FTA (ChAFTA) now published, we take a closer look at some of the outcomes in the Investment Chapter. The ChAFTA Investment Chapter contains a number of interesting and innovative features and we have reviewed three of these (click on the links below):
– ChAFTA’s innovative ISDS safeguard for government regulation;
– ChAFTA’s relatively limited scope and future work program; and
– the relationship between ChAFTA and the 1988 bilateral investment treaty between Australia and China.
